Zynx Health Knowledge-base Software Products
Only “Authorized Personnel” of a hospital or other health care organization licensed by Zynx Health Incorporated (“Zynx Health”) may have access to and the right to use this software (including, but not limited to, the ZynxEvidenceTM, ZynxCareTM, ZynxOrderTM, Zynx AmbulatoryCareTM , ZynxMeasurementTM , and Zynx OncologyCareTM ). “Authorized Personnel” includes only those employees, contractors and/or physicians or other licensed health care staff having privileges at hospital or other health care organization licensees, who are trained in the use of the knowledge-base software on this site and have a need to access and use this software. If you do not qualify as “Authorized Personnel,” you should exit this program immediately.
If you qualify as “Authorized User,” you should be aware of the following:
(i) While Zynx Health has attempted to incorporate key literature into its knowledge-base software products, the software is not all-inclusive or necessarily complete, and there may be omissions, typographical and other errors, conflicting information or inaccuracies in the software database.
(ii) You and the other health care providers responsible for patient care will retain full responsibility for all decisions relating to patient care, and the knowledge-base software is not to be used as a substitute or replacement for diagnosis or treatment recommendations or other clinical decisions or judgment.
WHILE ZYNX HEALTH HAS SOUGHT TO DESIGN ITS SOFTWARE PRODUCTS AS TIME-SAVING SOFTWARE TOOLS TO MAKE MEDICAL AND OTHER SCIENTIFIC INFORMATION AVAILABLE TO ITS USERS, AND AS A FORECASTING TOOL, ZYNX HEALTH AND ITS LICENSORS AND DISTRIBUTORS ARE PROVIDING AND LICENSING THE KNOWLEDGE-BASE SOFTWARE PRODUCTS ON AN “AS IS” BASIS, WITHOUT WARRANTY OF ANY KIND, AND ALL EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS AND WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT, ARE EXCLUDED BY ZYNX HEALTH, ITS LICENSORS AND DISTRIBUTORS. ZYNX HEALTH DOES NOT WARRANT THAT THE KNOWLEDGE-BASE SOFTWARE PRODUCTS WILL OPERATE ON AN UNINTERRUPTED OR ERROR-FREE BASIS, AND NO REPRESENTATION OR WARRANTY IS MADE AS TO THE SELECTION OR ACCURACY OF THE DATABASE CONTENTS, OR WHETHER SUCH DATABASES CONTAIN AN IDENTICAL OR ACCURATE REPRODUCTION OF THE ORIGINAL LITERATURE OR SOURCE MATERIALS. ZYNX HEALTH DOES NOT REPRESENT OR WARRANT THAT THE USERS OF ITS KNOWLEDGE-BASE SOFTWARE WILL NECESSARILY ACHIEVE THE COST-SAVINGS OR CLINICAL OUTCOMES CALCULATED BY THE FORECASTING SECTION OF THE SOFTWARE SINCE THESE FORECASTS ARE MERELY ESTIMATED BENEFITS AND PROJECTIONS.
